NEW YORK — A New York City judge says he won't order the release of hundreds of documents the CIA has refused to make public regarding the destruction of videotapes of detainee interrogations following the Sept. 11 attacks.

Manhattan federal Judge Alvin Hellerstein ruled Wednesday after viewing a few of nearly 600 documents related to the CIA's 2005 destruction of videotapes documenting new harsh questioning techniques.

He said a federal judge must defer to the CIA director in assessing information related to such an issue of national security.

The judge also said he probably would have ruled on the same grounds that the videotapes would not have to be released if they had not been destroyed.

A lawyer for the American Civil Liberties Union says he doesn't know if he'll appeal.

Decision On Petition's Legality Expected By End Of Week

Supreme Court Justice Edward Lehner has begun consideration of NYC CAN’s motion to reject Referee’s Louis Crespo’s recommendation that the NYC CAN 9/11 petition not be submitted to the voters on November 3. The petition would ask whether or not there should be an independent New York City investigation into 9/11.

Responding to a motion brought by NYC CAN attorney Dennis McMahon, a hearing was held Tuesday September 29 at the New York State Supreme Court, and concluded with the understanding that the Court will likely render a decision on the petition’s legality by Friday, October 2.

Gore Vidal: ‘We’ll have a dictatorship in the US soon"

He’s acting as if Afghanistan is the magic talisman: solve that and you solve terrorism.” America should leave Afghanistan, he says. “We’ve failed in every other aspect of our effort of conquering the Middle East or whatever you want to call it.” The “War on Terror” was “made up”, Vidal says. “The whole thing was PR, just like ‘weapons of mass destruction’. It has wrecked the airline business, which my father founded in the 1930s. He’d be cutting his wrists. Now when you fly you’re both scared to death and bored to death, a most disagreeable combination.”

A LETTER TO THE 9/11 COMMUNITY FROM DAVID RAY GRIFFIN

Dear Friends and Colleagues:

I am writing in support of the international campaign, headed up by Elias Davidsson (who long lived in Iceland but now lives in Hamburg, Germany), calling for a new trial for Mounir El Motassadeq, who has been convicted of assisting the 9/11 attacks.

I have known Elias Davidsson for several years and know him to be an extremely careful researcher into the 9/11 attacks and also to be a passionate advocate for justice.

When I was in Hamburg last fall, I went with Elias to see Mounir's lawyer. He seems to be a good man and a capable lawyer, who will represent Mounir well if he gets the opportunity.

I agreed to be on the committee for Mounir along with Elias and a few others, including Annie Machon and Barrie Zwicker.

Incidentally, Mounir did indeed know Mohamed Atta. But in response to the question of whether the Mohamed Atta he knew in Hamburg was the same as the Mohamed Atta whose picture is in The 9/11 Commission Report, he said that they looked very different.

Thousands of 9/11 workers can now sue over illnesses

Thousands of sickened 9/11 recovery workers whose legal claims have been barred because of missed deadlines can now join a massive group suing New York City under a law signed by Gov. David A. Paterson, officials said.

The law immediately allows more than 3,000 Ground Zero workers to revive lawsuits that were thrown out by a federal judge in July on the technical ground that they were not filed within 90 days of the workers' conditions being diagnosed.

It will also allow new lawsuits from an untold number of workers who never even filed claims.

One of them is Chris Klein, 38, a carpenter from Broad Channel, Queens, who worked for three months at Ground Zero in 2002 and is now on disability with a lung condition. Attorneys told him he waited too long after his diagnosis in 2004 and couldn't file a lawsuit.

"I put my life on the line to help the city and the state, and we were lied to that the air was good to breathe," said Klein, who said he also has been diagnosed with post-traumatic stress disorder, depression and chronic sinusitis.
