Statement Of September 11th Advocates Regarding Reaction To AG Eric Holder’s Announcement On Moving 9/11 Trials To NYC

We are encouraged by Attorney General Eric Holder's announcement that the trial of alleged 9/11 mastermind, Khalid Sheikh Mohammed, and four additional detainees, Walid Muhammed Salih Mubarak Bin Attash, Ramzi Bin Al Shibh, Ali Abdul-Aziz Ali, and Mustafa Ahmed Al Hawsawi, would be moved to our Federal Court system in New York City.

Unfortunately, this has evoked a knee-jerk reaction that has been brought to an almost feverish pitch by the media pundits and the politicians. This response seems to be agenda driven rhetoric unsupported by facts.

Fear mongering is a tactic that is often used by those in power to hide wrongdoing. Perhaps those responsible for ordering torture have something to hide. Could those people be creating this frenzy?

With the apparent desire to try these suspects in the military commission system, one would think that the success rate of prosecutions would be higher than that of the Federal Courts’, but that is not the case. To date, the military commissions system has had a very low success rate and has only brought one 9/11 terrorist case to completion. On the other hand, the American Justice System has been used to try terrorists 214 times since September 2001, with a success rate of 91% - 195 people were convicted.

The one 9/11 related case that was brought to completion in the military commissions system, U.S. v. Hamdan (Bin Laden's driver), brought Hamdan only a 66 month sentence. He was sent back to Yemen in January 2009. Where was the outrage then?

In fact, having accused September 11th alleged terrorists on American soil, in Federal Court, is not precedent setting. The alleged 20th hijacker, Zacharias Moussaoui, was held in a Virginia detention center and was later sentenced in Federal Court, also located in Virginia. Where was the outcry at that time?

During the course of that hearing, we fortunately did not experience a terrorist incident. Admittedly, an attempted attack could occur whether we try these suspects in America or Guantanamo Bay, Cuba. Does that mean we should not try them at all?

It should also be noted that the military commissions system allows for secret proceedings where tainted evidence and hearsay could be used. Thus, any resulting verdict could lack credibility. For those who fear an attack because trials are being held on American soil, isn’t it just as likely that a verdict lacking credibility could provoke an attack?

Additionally, we believe the decision to try these men in our Federal Courts is less about giving detainees the same privileges as American citizens and more about America being a nation that conducts itself according to the rule of law. As a matter of practicality, in order to protect our citizens and soldiers around the world, it is best that we not devolve into barbarians seeking revenge. Retaliation then becomes an even greater risk.

It is time that we actually look at the facts and stop reacting from a place of fear.

Agree 100% with the statement. The civil, open trial is benefit

Now to the sheik. He has something against him that should bring him at least life in prison. And that is badly mistreating and factual killing / 'his hands'/ of American hostage journalist Daniel Pearl in Pakistan.

As to his 9/11 testimony, under the duress of quasi torture, that has almost no real value. He might have wished 9/11 attacks to happen, and might have helped organize them, but the directly responsible are dead with the airplanes.

Sheik and all Arabs involved in the 9/11 inside operation attacks probably never knew, and do not know now, that they were aided, allowed, and helped by inside forces. ... Without that, no 9/11pretext for war inside job controlled demolition would have happened.

Many Arabs, former friends of USA, started to hate US after bombing apart and occupation of Iraq 91-03. That is not a crime, however, 1.. they cannot plan and carry out terrorist actions, 2.. USA should not use /genocidal/ force in foreign policy and occupations., 3 .. US should prevent known terrorist planned actions, and NOT use them to carry out inside false flag ops on the US soil.

KSM weight watchers

I'm just really really impressed at how KSM has pulled himself together from his middle of the night capture in Pakistan back in '03....
we're actually still treated to that "what time is it, what a night" look he had -- very heavy set, stretched neck tshirt, wide face and uncontrolled hair...back in 03.... but what about his new "forget weight watchers try CIA reprogramming diet" new Mug shot they are showing now --- in full head arab garb --- thin - -and suddenly: HUGE EYES --- and other facial features that DO NOT match the pakistan 03 pic.

the bottom line is the 911 commission used the info gleamed from torturing this guy to paint the 911 official narrative -- NOBODY has ever seen him since that capture that even in 03 -- newsmen commented that the whole event with pakistani police arresting him seemed very staged--

but now we have this picture of thin -- elegantly dressed arab with big bambi eyes - with a "hello my name is KSM, I did it all" - -doesn't make sense.

Obviously this other guy is a stooge - and they're doing a "real trial " to give the people "real theatre" -- this is staged.

Well, rule of law is pretty basic, and the other side is basically just frothing and belligerent so it's not a difficult statement to make, and to refute them with facts. I think it's mainly the hardcore rightwingers and uneducated that would choose military over civil.

The more meaningful questions are not really included here. This is mainly a response to extremist claims.

Adding on that the death penalty should be outlawed in the US, would have been something else. Lots of facts to tack on about that, like what other countries can be grouped in with the US as engaging in that brutal act still.

Not according to this latest poll. Are most Americans "hardcore rightwingers" and "uneducated?" Doubtful.

But they are included here, and it is our job to make people aware of them. Something very few people seem willing to do on a consistent basis. These wouldn't hurt either. The "extremist claims" are winning on the media front in case you didn't notice. There are more people saying not to give them a trial then to give them a trial.

Families in Courtroom

Will the Jersey Girls be allowed in the court-room? Obviously if this is to ostensibly provide justice to the victims' families then many family members should be allowed in, particulary the FSC.

If so, then the world's media will want to get their take and they might have the opportunity to voice objections, concerns, unanswered questions, etc.,-- That only a new INVESTIGATION can get them answers.

Hopefully this could be the media attention for the Jersey Girls that the '06 National Press Club was supposed to be.
