UPPER DUBLIN - It took recovery workers just two days to discover 26-year-old Bobby McIlvaine's burned remains amid tall mounds of pulverized debris at the World Trade Center.

Nearly five years later, the victim's father, Robert McIlvaine, recalled that dental records were necessary to positively identify his son on Thursday, Sept. 13, 2001.

"It was brutal," McIlvaine said.

Bobby McIlvaine, a Princeton University graduate, was hired to work in Merrill Lynch & Co.'s offices across from the World Trade Center just weeks before the horrific attacks on Tuesday, Sept. 11.

That day, after getting news of the attacks, Robert and Helen McIlvaine waited for their son to call.

"I wasn't overly concerned, because Bobby didn't work in the (World Trade Center) towers," he said.

But Bobby didn't call the couple's Oreland home.

On Wednesday, McIlvaine and his younger son, Jeffrey, took a train to Manhattan and began a frantic search for information about Bobby's whereabouts.

When President Bush learned of the second plane hitting the South Tower, he seemed puzzled, but not particularly upset or surprised. He continued reading to the children. The Secret Service is trained to act quickly and decisively to protect the president — why did they let him remain in a public place for more than seven minutes when our country was under attack?

According to radar data, American Airlines (AA) 77 was flying at 400 mph at 9:35 a.m. and passed over the Pentagon at 7,000 feet. The plane then made a very difficult high-speed descending turn in a downward spiral, dropping 7,000 feet in two-and-a-half minutes. How could the terrorists have done this difficult turn when their flight instructors have stated they were incompetent as pilots of even a small plane? ..."

Emotional shell game accusation of 'disgracing victim's memories' doesn't jive anymore

Another 9/11 family member has gone public to rubbish the conspiracy theory that the attacks were planned and executed by nineteen incompetent Arabs with box cutters who were getting drunk in a strip club the night before and barely even made it to the airport on time. Meanwhile, hit pieces against the 9/11 truth movement continue in the lead up to the fifth anniversary of the event.

A familiar emotional shell game on the part of the debunkers is to proclaim that questioning any aspect of 9/11 disgraces the memory of the victims. This tactic is clearly not working anymore especially in light of the fact that Bill Doyle, representative of the largest group of 9/11 family members - says that half now completely distrust the official version of events.

One of the best-known "9/11 widows," Lorie Van Auken, tells me that she went to see a comedy recently. She settled into her seat, waiting to laugh -- and then the trailer for Stone's movie exploded across the screen. "And I see people trapped under the rubble and I start crying and running hysterically out of the theater," Lorie says.

Her husband, Kenneth, worked on top of the North Tower, in the investment firm Cantor Fitzgerald. Lorie and other family survivors played a key role in pressuring Congress and the federal commission to investigate Sept. 11. "I am not going to see the movie," she says. "I've spent five years imagining a million different ways of how my husband was trapped and died, and I've seen a lot of them in my nightmares. I can't handle going to a theater and watching them."

Lorie says she doesn't begrudge Stone for making the film, but says "If I had made it, I would have made it a lot more political and investigative. There are still so many questions about Sept. 11 that the government has never answered."

Now, nearly five years after the historic disaster, roughly 60 lawsuits are still grinding their way through court. And the families pushing ahead with litigation, including numerous New Englanders, are mired in a massive legal case that has become a complicated behemoth for the federal judge overseeing it.

The case pits those who consider the day's events an unpreventable tragedy against others who believe government and aviation officials ignored clear warnings that such an assault was possible. That lapse, in their view, led to the deaths of beloved friends and relatives, and they now want accountability and answers.

For some litigants, their decision to sue was met by public disapproval from skeptics who questioned their motives and dismissed their quest for justice as futile. But in interviews with the Globe, many family members said they are committed to pursuing the case until government, airline, and security officials are held responsible for their roles in the attacks. And they are aware that litigation is a gamble that could produce neither answers nor money, they said.

Still, many of the firm's clients say they sued not for financial gain, but because they believe litigation will fully reveal whether government and aviation officials could have anticipated and prevented the events of Sept. 11. Some also sued because life insurance and other "offsets" would have reduced their payments from the compensation fund, which awarded $2 million in death cases and $400,000 in injury cases, on average.
