"I've chosen to go to court rather than accept a payoff from the 9/11 victims compensation fund. Instead, I want to know what went so wrong with our intelligence and security systems that a band of religious fanatics was able to turn four U.S passenger jets into an enemy force, attack our cities and kill 3,000 civilians with terrifying ease. I want to know why two 110-story skyscrapers collapsed in less than two hours and why escape and rescue options were so limited.

I am suing because unlike other investigative avenues, including congressional hearings and the 9/11 commission, my lawsuit requires all testimony be given under oath and fully uses powers to compel evidence.

The victims fund was not created in a spirit of compassion. Rather, it was a tacit acknowledgement by Congress that it tampered with our civil justice system in an unprecedented way. Lawmakers capped the liability of the airlines at the behest of lobbyists who descended on Washington while the Sept. 11 fires still smoldered.

And this liability cap protects not just the airlines, but also World Trade Center builders, safety engineers and other defendants.

The caps on liability have consequences for those who want to sue to shed light on the mistakes of 9/11. It means the playing field is tilted steeply in favor of those who need to be held accountable. With the financial consequences other than insurance proceeds removed, there is no incentive for those whose negligence contributed to the death toll to acknowledge their failings or implement reforms. They can afford to deny culpability and play a waiting game.

By suing, I've forfeited the "$1.8 million average award" for a death claim I could have collected under the fund. Nor do I have any illusions about winning money in my suit. What I do know is I owe it to my husband, whose death I believe could have been avoided, to see that all of those responsible are held accountable. If we don't get answers to what went wrong, there will be a next time. And instead of 3,000 dead, it will be 10,000. What will Congress do then?

So I say to Congress, big business and everyone who conspired to divert attention from government and private-sector failures: My husband's life was priceless, and I will not let his death be meaningless. My silence cannot be bought."

Listening to the tape, it sounds like what the pilot of 1998 said was "... nothing on the TCAS."

TCAS (pronounced T-cass) stands for Traffic Collision Avoidance System, which sends out a lower power non-directional radar pulse and listens for any aircraft transponders in the vicinity. in order to warn pilots of close approaching aircraft. So, what the pilot of Delta 1998 is saying is that at the time ATC asked him to look for a Dash-8 at 2300, 3407's radar transponders had quit working.

One final note. If the Air Traffic Controller is telling the pilot of Delta 1998 to look at 2300 feet altitude for the Dash 8, then that means the last altitude reading returned to the ATC was 2300 feet. Air Traffic radar never received a return showing a loss of altitude, which strongly suggests that the aircraft's entire electrical system quit working while the plane was still half a mile in the air.",0,737...

Damn. I hate to get drawn in to controversial suspicions based on speculation but the timing of this event and the coincidence of recent events regarding Beverly Eckhart sure begs question.

Around the time of the crash it was calm, visibility was 10 miles, mostly cloudy. Here is what the codes mean for the middle section:

If none of the sky is covered at all, the code is simply SKC (for sky clear).
If 1/8 to 2/8 of the sky is covered at the given layer the condtion code is FEW
If 3/8 to 4/8 of the sky is covered, the condition code is SCT (for scattered)
If 5/8 to 7/8 of the sky is covered, the condtion code is BKN (for broken)
If 8/8 of the sky is covered, the condtion code is OVC (for overcast) and no further layers are given
BKN050 OVC100 Broken at 5,000 feet, Overcast at 10,000 feet

If I'm reading this right, sky condition is broken at 1,600 feet and broken at 10,000 feet. Air temperature is 25 degrees, dew point is 18. Last two numbers deal with pressure.

nothing can be trusted. It is possible that the combined data could mean icy conditions. I honestly haven't a clue. A meteoroligist could determine this, I'm sure, by looking at the data. What I find odd is that the pilot did not mention any icing to air traffic control - a potentially fatal condition.

It does no good to speculate.

I am willing in this case to accept that sometimes coincidences are just coincidences no matter how weird.
This is an unfortunate and sad accident and my thoughts and prayers go out to the families of the victims.

"1.) The de-icing boots on this aircraft are designed to be left on all the time, they will not reform the ice and make it worse as with older styles.
2.) The correct manouever to pull a plane out of a stall CREATED by ice is completely opposite depending if it is a wing stall or tail stall. In other words, if you have both wing stall and tail stall, you are totally screwed and cannot pull out. It appears this plane had both conditions.
Which is why they should absolutely NOT have been on autopilot. If you notice ice forming on the main wings, then you can be sure it has been forming for quite some time on the tail section,which you cannot see, which could have been detected by adjustments in trim and speed by an astute pilot.
3.) De-icing boots only de-ice the leading edge of the wing, it is ice that forms on the underside of the wing, just past the boot area that can change the aerodynamics of the wing and create a void that will pull down your flaps and require up to 170 lbs pressure to get back.
The second they extended the flaps, they were doomed. If they immediately pulled them in, they possibly could have had a chance to re-inguage airflow.
4.) From all accounts, this plane encountered freezing rain somewhere on the flight which created the icing anomaly. The proper procedure is to declare an emergency, and head to another area in hope of finding warmer air to melt the ice. There is NOT an airplane made that can deal with Supercooled Water Droplets.

Some other questions to ask

Sorry I didn't pay more attention at first. This does sound like a good time to organize the right questions to ask, the evidence to be searched for.
Just a few that occur to me:
How closely does this compare to the crash of US Senator Paul Wellstone's plane on October 25, 2002?
Altitude at failure/ power loss, distance from runway,
exact location at failure and what types of landscape was it passing over at time (locations for potential interference),
Record of that model of plane in that kind of weather,
Record of the airline (actual, not code-sharing),
Experience of the crew with that type of weather,
Custody of the ATC tapes,
any reports of odd electrical behavior in the neighborhood above the FAILURE at time of the failure,
does the official investigation follow the by-the-book procedure or are there interesting deviations from procedure for no apparent reason, especially if they suppress or ignore evidence,
how much lead time was there before it would have been known that TWO "persons of interest" would be on this flight (or either one) especially after the meeting with Obama --
or it became evident to 'someone' of the potential for the consequences of the Obama-meeting to get "out of hand", even slightly,
Who actually does this investigation, and which other air-crash investigations have they been involved in,
Were there any other planes in the area, before or after, that report any problems with icing, etc... and would they be expected to have the same if it was icing,
how soon were investigators on the scene, and were their actions odd or suspicious?

Do the photos of the crash site really indicate much about the plane's handling in the final minutes?

Certainly by now it ought to be possible to put together a standard set of questions (and at least official data sources to watch) about plane crashes from this perspective.
In fact, are there any sites or groups already doing such preparation pre-emptively?

there was a report initially that the flight was delayed in newark for mechanical reasons, and work
was done on the plane before departing. then today, the fbi agent handling the press said that
that earlier report was mistaken, there was no mechanical problem in newark addressed before
the departure of the flight. he said there was just delays due to high winds in newark. this press
conference interrupted buffalo local feed of the golf tournament at pebble beach saturday pm, and
the press conference continued for many minutes.

i will review the transcripts of the press conferences held locally for earlier statements and reports
regarding what was said about the flight delay in newark.

but i think it is important to remember that newark was where the flight departed from. buffalo has
bad weather all the time, especially this time of year, and this was a very weird week with the weather,
as it went from warm (mid 40s) to cold (20s) very quickly from wednesday to friday. the flight crashed
late thursday night. in the midst of this unusual radical shift in temperatures.

the autopilot was in use, but the autopilot shut off just a half minute after the landing

the level of icing remains debatable, though it has become the chief factor discussed
in explaining the accident. but there are important skeptics of blaming the weather,
especially long time buffalo observers of the weather, who note there was nothing
severe about the weather conditions that evening.

in a new york times story of monday 2/16/09, they cite Don Paul, the chief meterologist
for WIVB-TV the CBS affiliate in Buffalo. Paul has worked in Buffalo since 1984 (25 yrs)
and said the last weather observation on Thursday, taken at 954pm, 26 minutes before
the crash, showed that the temperature on the ground was 33 degrees, with wind from
the southwest blowing at 17 miles per hour, visibility of 3 miles and skies free of clouds
up to 2,270 fee. According to the NYTimes, "Mr Paul said 'a dime-a-dozen winter weather
conditions' that were 'not even close to minimum flight safety conditions'."

This was the first ever crash of a commercial airplane in Buffalo, weather-related or
otherwise, according to the NYTimes, citing Mr. Paul.

"In fact," he said, "this place is famous for keeping the airport open, for being a highly
efficient airport, in difficult weather conditions, and these were not difficult conditions,"
he emphasized.

so an uneventful flight turns tragic and dive bombs into the ground all in the space of
twenty six seconds, on an average or above average winter evening at Buffalo Niagara airport,
ruining the perfect record of flying in and out of Buffalo for commercial aviation.

CLARENCE, N.Y. – An investigator says the plane that crashed on a house in New York state landed flat on it and was pointed away from the airport where it was supposed to land.

Steve Chealander (CHEE-lan-duhr) said Saturday that Continental Connection Flight 3407 did not dive into the house, as initially thought.

Chealander says the New Jersey-to-Buffalo flight was cleared to land on a runway pointing to the southwest. But the plane crashed with its nose pointed to the northeast.

He also says the catastrophic nature of the crash means it could take three or four days to remove human remains.

Forty-nine people on the plane and one person in the house died in the fiery crash late Thursday.

CLARENCE, N.Y. (AP) — Crash investigators picked through incinerated wreckage Saturday, gathering evidence to determine what brought down a commuter plane that plunged into a home and exploded.

It could take days to recover all human remains from the plot of land where a single-family home stood before Continental Connection Flight 3407 nose-dived into it late Thursday, National Transportation Safety Board spokesman Steve Chealander said.

Experts were analyzing data from the black boxes, including statements by crew members about a buildup of ice on the wings and windshield of the plane, Chealander said.

But authorities have yet to pin that as the cause of the crash, which occurred during a light snow and mist, killing 49 people on the flight and one man in the home.

Ice on wings can cripple an aircraft and has been blamed for several previous plane crashes. Other aircraft in the area Thursday night told air traffic controllers it also experienced icing around the time that Flight 3407 from Newark, N.J., to Buffalo went down.

Icing is one of several elements being examined by investigators, who plan to remain in Buffalo for another week before shipping plane parts to locations around the country for study, Chealander said. A full report will likely take a year, he said.

"We're in the very early stages of the investigation," he said. "The icing and other things are just preliminary focuses."

One aspect of the investigation will focus on the crew, how they were trained and whether they had enough time to rest between flights. Other investigators focused on the weather, the mechanics of the plane and whether the engine, wings and various mechanics of the plane operated as they were designed to.

But recovery of the bodies will take priority over the investigation, Chealander said.

The remains-recovery effort was being led by Dennis Dirkmaat, a forensic anthropologist from Mercyhurst College in Erie, Pa., and a nationally renowned expert who led the recovery effort after United Flight 93 crashed in Shanksville, Pa., on Sept. 11, 2001.

The crash site remained off limits Saturday, with police barring reporters and photographers from the neighborhood.

Authorities still haven't released a list of the victims of the nation's first deadly air crash in 2 1/2 years, but reminders of the disaster were visible all around the Buffalo area.

Flags flew at half-staff outside Buffalo Niagara International Airport and at Clarence Town Hall, the site of a command center set up by police.

Family members of the victims were sequestered in a hotel Saturday where they were scheduled to meet with representatives of Continental Airlines. Police turned away reporters.

The 74-seat Q400 Bombardier aircraft was operated by Colgan Air, based in Manassas, Va. Colgan's parent company is Pinnacle Airlines of Memphis, Tenn.

This is the first significant thing I've seen. this Dennis Dirkmaat being used. How often is he used, he is the common forensic member? Why is he being used. If he has only done two, 93 and this, that is a big UMMMMM.

I live south of Buffalo and I am not horribly far from the flight path.

It is hard to watch it in TV as it is on all the time and my mind could not take the constant upset it causes me.

OK, I did not watch a lot of it today but they said on wgrz TV that the plane was on autopilot when it went down. I fell down quite fast in 5 seconds. I can't recall how far but it was horribly far for that time.

Go to for info and the other station is wivb and the last one is wkbw TV.

They are picking up the bodies now and want to clear it up all by Wed because of a storm that is supposed to be heading this way.

Also The weather before on that day was horrible. Up to 60 miles or more of wind but that was earlier in the day. My yard was littered with branches and some trees fell but in my part of town there was no ice storm or raining ice.

A guy who got off the flight that landed before that crash said he flight had trouble as well and they could tell their flight was not landing normally but it did land. Wben radio had interviews that the tv stations did not have.

I don't know what else I can say to give you more info. I had thought of this too and why I came here to see what was being said.



It could be just a tragic accident.

But it never hurts to ask deeper questions. Especially with the "government" we have.

Flight 3407 was on autopilot when it went down in icy weather near Buffalo, indicating that the pilot may have violated federal safety recommendations and the airline's own policy, a federal official said Sunday.
National Transportation Safety Board investigator Steve Chealander said the company that operated the flight recommends pilots fly manually in icy conditions.
"You may be able in a manual mode to sense something sooner than the autopilot can sense it," Chealander said.
Pilots are required to switch off the autopilot device do when facing severe ice.
Flight 3407 pilot Marvin Renslow reported "significant" ice on the wings and windshield just before crashing on Thursday night near Buffalo, killing 50.
An NTSB safety alert in December said pilots in icy conditions should turn off or limit the use of the autopilot to better "feel" changes in the handling qualities of the airplane.
Chealander said it is still not clear exactly when the pilot on Flight 3407 turned on the plane's advanced deicing system.
The revelation contradicts previous statements by Chealander in which he said there was no indication autopilot was on when the plane crashed.
It also gives investigators new insight into what may have downed the twin turboprop aircraft.
"If the autopilot is left on while the ice is building up, the pilot may suddenly be confronted with a very difficult situation," William Voss, president of the Flight Safety Foundation, told the Toronto Star yesterday.
"Ice actually changes the shape of the wing," Voss said. "If you don't keep the wings clean you could find yourself in a situation where ... suddenly the aircraft decides to quit flying."
A turboprop plane running on autopilot in icy conditions crashed in Roselawn, Ind. in 1994, killing all 68 people onboard.

There's a possibility that the plane went down because of foul play,
sabotage. All the news I've heard indicate that ice was the problem, but
if the de-icing equipment were disabled, that would make the crash mass
murder. And there was at least that one 9-11 investigation activist
aboard. If the 9-11 matter is properly investigated, Dubya's and
Cheney's gooses are cooked, fried, or at least due for a date with
firing squads.

If I were an FBI guy, I would NOT WANT ANYONE messing with the potential
crime scene except trusted top-notch investigators. Regardless whether a
person appears to be a teen or an old drunk, they might be guys working
for the Cheney gang trying to cover something up.

I hope to heck the feds are really investigating, not covering up, and
it sounds like they're investigating. America may recover and Bush and
Cheney may do the perp walks they should after all.

Sounds like the Wellstone crash

If I recall correctly, Sen. Paul Wellstone's plane crashed under similar circumstances. I recall having read that electronic devices in cars and homes in the area all went out about the time of the Wellstone crash, implicating the use of an electromagnetic pulse device. We need to find out whether there were any detectable outages in the vicinity just before the crash, and whether an electromagnetic pulse would affect electronics on the ground from half a mile up.

No power went out for I did hear the interview of the ladies that survived in the house they were watching tv when the roof colapsed on them. The ladies in the front and back of the house got out. The hubby in the middle died.
