Thomas McGuinness, the co-pilot of American Airlines Flight 11 before it became the first plane to be hijacked in the 9/11 attacks, only assigned himself to be on the flight the afternoon before September 11, 2001, and pushed from it the original co-pilot, who had put his name down for the flight less than half an hour earlier. This new information means that, curiously, half of the pilots and co-pilots originally at the controls of the four aircraft involved in the attacks are now known to have been assigned to the doomed flights at the last minute, very shortly before September 11. Additionally, more than half of the flight attendants and many of the passengers are known to have, similarly, not originally been booked onto those flights.

The details of McGuinness's late assignment to Flight 11 were revealed recently by Steve Scheibner, who was originally going to be the plane's co-pilot. In a short film released on the Internet just before the 10th anniversary of 9/11, Scheibner described how McGuinness came to replace him on Flight 11 and thereby saved his life.

FLIGHT 11 HAD 'NO PILOT ASSIGNED TO IT YET'
At the time of the 9/11 attacks, Scheibner was a fundamentalist Baptist pastor and a commander in the Naval Reserves, but he also worked part-time as an on-call pilot for American Airlines. [1] He had been available to fly on September 11. "So at about three o'clock in the afternoon of September 10," Scheibner recalled, "I sat down at the computer and I logged in like I normally do, to check to see if there was any unassigned flying for the next day. And sure enough there was one trip that was available on September 11. It was American Airlines Flight 11 out of Boston's Logan Airport to Los Angeles." Scheibner looked at the flight and could see that "there was no pilot assigned to it yet."

When researcher and author David Ray Griffin decided to call his first book on September 11 “The New Pearl Harbor” it was more than a passing suggestion that an historic analogy existed between the two events.

The more we learn about September 11, the more we realize that also the internal dynamics in both events bear a chilling resemblance between each other.

ALBANY — The NYPD would be required to provide the list of cops who worked at Ground Zero to cancer researchers under legislation being drafted in the Legislature.

The measure was requested by the police officers union, which says the studies could help secure needed federal health money for ailing cops.

Scientists at Mount Sinai Medical Center in Manhattan have asked for the full roster of officers who served at Ground Zero, but the NYPD’s surgeon refused, citing privacy concerns.

Assemblyman Micah Kellner (D-Manhattan) and state Sen. Diane Savino (D-S.I.) ripped the decision and promised to introduce a bill as soon as next week compelling the NYPD to comply with the request.

“These were the heroes of 9/11, and they deserve the best health care possible,” Kellner said. “If there is a higher rate of cancer, we need to find that out through the best study possible, and that means releasing this list.”

Silverstein’s 9/11 Lawsuit Against Airline Continues

Under a new agreement, the bankruptcy of American Airlines’ parent company won’t completely halt pending litigation from the World Trade Center’s developer over claims the carrier failed to prevent the hijacking of Flight 11 during the Sept. 11th terrorist attack.

In a long-running legal battle, World Trade Center developer Larry Silverstein has accused AMR Corp. and its American Airlines subsidiary of failure to put into place safeguards — such as securing the cockpit — to prevent terrorists from seizing control of its airplane. Flight 11 crashed into the site’s North Tower with 81 passengers and 11 crew members on board.

AMR’s Chapter 11 filing last November automatically put a stop to all pending litigation against the company, including the World Trade Center suit. But under the deal AMR filed in bankruptcy court Thursday, plaintiffs may continue pursuing injury and damage claims “solely to the extent of available and collectible [insurance] coverage.”

Court papers show the agreement, which isn’t subject to court approval, precludes plaintiffs from trying to recover for “intentional conduct or punitive damages.”

Silverstein’s company, which leased the Twin Towers and two other World Trade Center buildings from the Port Authority of New York and New Jersey, is seeking billions of dollars in damages for alleged negligence by the airline, according to the lawsuit. It is also seeking compensation for the lost rental income; the developer had signed 99-year leases for the space just two months before the attack.

Feb 2 (Reuters) - A federal appeals court on Thursday sanctioned lawyers behind a lawsuit accusing former officials in the Bush administration of orchestrating the Sept. 11 attacks.

The U.S. Court of Appeals for the 2nd Circuit ordered two California lawyers to pay $15,000 in addition to double what the government spent defending the case. For the next year, the lead lawyer behind the litigation must inform other federal courts in the circuit of the sanctions against him.

Three attorneys -- Dennis Cunningham, William Veale and Mustapha Ndanusa -- filed the lawsuit in 2008 on behalf of April Gallop, a member of the U.S. Army injured in the Pentagon attack on Sept. 11, 2001. The lawyers accused then-Vice President Dick Cheney and Donald Rumsfeld of causing the attacks on the World Trade Center and the Pentagon in order to create a political atmosphere that would allow the U.S. government to pursue domestic and international policy objectives. The suit alleged conspiracy to cause death and bodily harm and a violation of the Antiterrorism Act.

State and local resistance to the detention provisions contained in the National Defense Authorization Act continues to grow, rapidly emerging as a nationwide movement.

The Tennessee legislature will consider HB1629 and SB2669 in the 2012 session. The legislation would effectively nullify the detention provisions in the NDAA and would also require federal agents making an arrest in the Volunteer State for any reason to first obtain written permission from the county sheriff.

According to media reports Uwe Mundlos, Uwe Böhnhardt and Beate Zschäpe founded the National Socialist Underground (NSU) and committed at least ten murderers, two bomb-attacks and several bank robberies. The Neo-Nazi group built bombs in the late nineties and placed them in the public. They were subsequently searched with arrest warrants from the year 1998 on. The first deadly attack happened on 09. September 2000, the last failed attack on 04. November 2011, which resulted in the deaths of Mundlos and Böhnhardt. According to media reports Mundlos and Böhnhardt robbed a bank and fled by bikes and later by caravan. After several hours they noticed that the police was about to surround them. They phoned Zschäpe and gave her the order to ignite their apartment. Then they committed suicide. On 9th of November spiegel-Online.de reported that one person had a wound in the head and the other person had a wound in the breast. On 13th of November the prosecution Meiningen declared in contrast to the media-report, that based on the autopsy Mundlos and Böhnhardt died by direct head-shoots.

Here are some questions that members of the Senate Select Committee on Intelligence should ask the heads of the intelligence community when the panel meets Tuesday morning for Congress’ first public assessment in 2012 of worldwide threats.

Afghanistan

Afghanistan is the only country where substantial numbers of U.S. forces are fighting. President Obama and the NATO coalition have set 2014 as the date for all foreign combat forces to withdraw and the Afghan army and police to take over security responsibilities.

In the December 2011 National Intelligence Estimate (NIE) on Afghanistan, the community opinion was that gains from the 2009 troop surge have been mitigated by continuing government incompetence and corruption and insurgents’ ability to be resupplied from Pakistan sanctuaries. The apparent stalemate, if continued, endangers future stability as U.S. combat troops continue to depart, says the NIE.

The Afghan coalition commander, Marine Corps Gen. John Allen, and U.S. Ambassador Ryan Crocker signed a dissent to the NIE’s judgments, questioning the intelligence community assumptions about Taliban intentions, the capability of Afghan security forces and the speed of the U.S. withdrawal.

The American Civil Liberties Union (ACLU) has filed a lawsuit today in the US District Court for the Southern District of New York, complaining that the Obama Administration failed to respond to Freedom of Information Act (FOIA) requests relating to the assassinations of three US citizens in Yemen.

The ACLU condemned “the government’s self-serving attitude toward transparency,” arguing that the administration publicly and loudly releases bits of information related to the assassinations but declines to provide the full story, claiming the killings were “secret.”

The requests centered around the September 30 assassination of Anwar al-Awlaki, a New Mexico-born Muslim cleric that the administration regularly claimed was a “terrorist,” as well as his teenage son Abdulrahman al-Awlaki and US citizen Samir Khan. The ACLU sought information on the process through which the Obama Administration decides who lives and who dies, as well as on the legal rationale for “kill lists.”

Pakistan Says Prime Minister Was Mailed Anthrax Spores

ISLAMABAD, Pakistan — Pakistan’s prime minister, Yousaf Raza Gilani, received a postal package containing anthrax spores four months ago, his spokesman said Wednesday, adding a new dimension to the security threats faced by the country’s political and military leadership.

The package was intercepted by the prime minister’s security staff in October, according to the spokesman, Akram Shaheedi. The Pakistan Council of Scientific and Industrial Research, a government laboratory, established that the suspicious white powder it contained was anthrax spores, he said. A criminal case was filed on Tuesday, according to an Islamabad police officer, The Associated Press reported.

Government officials gave contradictory accounts of the identity of the sender, and they offered little sense of motive. While Islamist militants have repeatedly targeted senior government officials in suicide and bomb attacks, an assassination attempt using biological weapons would be an anomaly.

Since it began a decade ago, the federal government’s massive investigation of the 2001 anthrax attacks has been plagued by missteps and complications.

Investigators initially focused on the wrong man, then had to pay him a nearly $6 million settlement. In 2008, they accused another man, Bruce E. Ivins, who killed himself before he could go to trial.

Now, in the latest twist, the government has argued against itself.

In documents deep in the files of a recently settled Florida lawsuit, Justice Department civil attorneys contradicted their own department’s conclusion that Ivins was unquestionably the anthrax killer. The lawyers said the type of anthrax in Ivins’s lab was “radically different” from the deadly anthrax. They cited several witnesses who said Ivins was innocent, and they suggested that a private laboratory in Ohio could have been involved in the attacks.

The unusual spectacle of one arm of the Justice Department publicly questioning another has the potential to undermine one of the most high-profile investigations in years, according to critics and independent experts who reviewed the court filings.

“I cannot think of another case in which the government has done such an egregious about-face. It destroys confidence in the criminal findings,’’ said Paul Rothstein, a law professor at Georgetown University.
