Upholding a defending our constitution is patriotic duty of every citizen especially those in government who took an oath to support and defend. I haven’t seen any one in congress around the patriot act 1 and 2 hr 6166 { military commission act }saying that we don’t have the constitutional authority, but they are saying we have the right not just to aliens but anyone one the sectary of defense, and the president deems to be enemy combatants. This is not just executive tyranny but also judicial and legislative tyranny.
Ignorance and on behalf of the American people. The people are sitting on there hands not doing anything as hr 6166 was passed. What congress and the president did essentially was to cut the courts rate out of the equation. This bill dismantled the courts out of any supervisory role and if you are a citizen of this country and this administration deems you a enemy combatant there is no court of justice. There is only is a military court for you. Where you are judged by commissioned military officers, in which you have no constitutional rights, tried and judge in military courts.
It was pushed threw congress as on the direct order of the president because his staff and his republican allies in congress wrote it before anyone had the time to even look at the magnitude it had on the rights of the citizenry on the basis of fighting terrorism
You cant strips some one of its right on the bases of declaring them a enemy combatant and striped them of all there constitutional rights based upon the results of that label.
This government is fighting a metaphorical war. its not like the united states is fighting a war against a recognized foreign nation. Its fighting a war against international criminal gangs. in which these so called terrorist group have no soverign authority, no national government, structure or identity. These terrorist groups are no different then the mafia or the drug cartels. I could run down a list of groups that have that kind of criminal element to them in that sort of a international scope. If this can be done to terrorist by labeling them enemy combatants and have all these military provision apply to them. why cant it apply to the mafia or your local street criminal? Or any other criminal activity that the government could use the label of enemy combatant. Couldn’t the just extended to the war on crime, and stripe anyone of there constitutional rights they think that would be involved with any sort of criminal activity.
Enemy combatant isn’t even mention in our constitution how can a government make a label on someone and through out 200 years of American jurisprudence.
This concept that you can suddenly assert these unheard of powers from the executive by simply by labeling some behavior a war is simply un herd of. If that’s the case we come to the finale conclusion that if we declare war on anything or any type of behavior that this government can think of. Then every one that commits a so called crime can be declared an enemy combatant subject to torture and denied the provisions of the forth fifth six and seventh amendment and with no habeas corpus, throw you in a military prison in this country our out of the country.
